Terms of Service

1.1. By using ANYPROMT services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1.2. You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are of legal age.

1.3. If you are using services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1.4. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of modified Terms.

2.1. ANYPROMT provides access to various artificial intelligence services through a Telegram bot interface, including:

• Text generation using models like ChatGPT, Claude, Gemini, and others
• Image generation using Midjourney, DALL-E, Stable Diffusion, and others
• Audio and music generation services
• Video generation and editing tools
• Code generation and technical assistance
• Other AI-powered capabilities as made available

2.2. Services are provided through third-party AI providers. We act as an intermediary platform facilitating access to these services.

2.3. We reserve the right to add, modify, or remove services at any time without prior notice.

2.4. Service availability may vary based on third-party provider availability and technical limitations.

3.1. Account creation occurs automatically when you start using our Telegram bot (@anypromt_bot).

3.2. You are responsible for:

• Maintaining the security of your Telegram account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current information

3.3. You may not share your account with others or allow others to use your account.

3.4. We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activities.

3.5. One person may maintain only one active account unless explicitly authorized.

4.1. Our services operate on a token-based system. Different AI services consume different amounts of tokens per request.

4.2. Token packages available:

• FREE: 10 tokens (30 days validity)
• BASIC: 260 tokens for €16.90 (30 days validity)
• PRO: 680 tokens for €39.90 (30 days validity)
• VIP: 1,700 tokens for €43.30 (30 days validity)
• ELITE: 2,600 tokens for €59.90 (30 days validity)

4.3. Token consumption varies by service. Current rates are displayed in the bot before each request.

4.4. Tokens expire 30 days after purchase and are non-refundable after expiration.

4.5. We reserve the right to adjust pricing and token costs with reasonable notice.

4.6. Unused tokens from expired packages cannot be transferred or refunded.

5.1. We accept the following payment methods:

• Bank cards via Stripe
• Telegram Stars
• Cryptocurrency (USDT TRC20)

5.2. All payments are processed securely through third-party payment providers. We do not store full payment card details.

5.3. Prices are displayed in Euro (EUR) and other supported currencies. Currency conversion rates are determined by payment processors.

5.4. All sales are final unless refund conditions are met (see Section 6).

5.5. You are responsible for all applicable taxes, duties, and fees related to your purchases.

5.6. Failed payments may result in service suspension until payment is resolved.

6.1. Refund eligibility:

• Request must be made within 14 days of purchase
• Less than 10% of purchased tokens must have been used
• Valid reason for refund must be provided

6.2. Refunds are NOT available for:

• Expired token packages
• Packages with more than 10% tokens used
• Violations of Terms of Service
• Change of mind after 14 days

6.3. To request a refund, contact [email protected] with your transaction ID and reason.

6.4. Approved refunds are processed within 5-10 business days to the original payment method.

6.5. Cryptocurrency refunds may be subject to network fees and different processing times.

7.1. You agree NOT to use our services to:

7.1.1. Illegal Activities

• Violate any applicable laws or regulations
• Engage in fraudulent, deceptive, or illegal activities
• Facilitate or promote criminal activities
• Generate content for illegal purposes

7.1.2. Harmful Content

• Generate content that is hateful, discriminatory, or promotes violence
• Create child sexual abuse material or content
• Produce content that harasses, threatens, or harms others
• Generate spam, malware, or malicious content
• Create deepfakes or misleading content without disclosure

7.1.3. Intellectual Property Violations

• Infringe on copyrights, trademarks, or patents
• Generate unauthorized copies of copyrighted works
• Impersonate individuals or organizations
• Violate privacy or publicity rights

7.1.4. Platform Abuse

• Attempt to reverse engineer, hack, or exploit our platform
• Use automated tools to abuse or overwhelm services
• Circumvent rate limits or access controls
• Resell or redistribute services without authorization
• Share account credentials or tokens
• Create multiple accounts to abuse free tier

7.2. Violations may result in immediate account suspension or termination without refund.

7.3. We reserve the right to report illegal activities to law enforcement.

8.1. Your Content

You retain ownership of content you create using our services, subject to the following:

• You grant us a license to process your requests through third-party AI providers
• AI-generated content may be subject to limitations by third-party providers
• You are responsible for ensuring you have rights to use any input content

8.2. Our Platform

• ANYPROMT name, logo, and branding are our exclusive property
• Our platform code, architecture, and proprietary technology are protected
• You may not copy, modify, or reverse engineer our services

8.3. Third-Party Rights

AI providers (OpenAI, Anthropic, Midjourney, etc.) retain rights to their respective technologies and may have additional terms regarding generated content.

9.1. Service Disclaimer

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including:

• No guarantee of accuracy, completeness, or reliability of AI-generated content
• No warranty of uninterrupted or error-free service
• No guarantee of specific results or outcomes
• No warranty of merchantability or fitness for particular purpose

9.2. Content Disclaimer

• AI-generated content may contain errors, biases, or inaccuracies
• You are solely responsible for verifying and using AI-generated content
• We do not endorse or validate AI-generated content
• Content should not be relied upon for critical decisions

9.3. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid in the last 12 months
• We are not liable for third-party AI provider failures or errors
• We are not liable for user misuse of generated content

You agree to indemnify, defend, and hold harmless ANYPROMT, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use or misuse of our services
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you generate or submit
• Your breach of any representations or warranties

11.1. By You

You may terminate your account at any time by using the /delete_account command in the bot or contacting support.

11.2. By Us

We may suspend or terminate your account immediately if:

• You violate these Terms or Acceptable Use Policy
• We detect fraudulent or suspicious activity
• Required by law or law enforcement
• Your account is inactive for extended periods
• We discontinue services

11.3. Effects of Termination

• Access to services will be immediately revoked
• Unused tokens may be forfeited
• Generated content may be deleted after 30 days
• Refunds may not be available for violations

12.1. Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt informal resolution.

12.2. Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.

12.3. Governing Law

These Terms are governed by the laws of the jurisdiction where ANYPROMT is registered, without regard to conflict of law principles.

12.4. Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitration.

13.1. We reserve the right to modify these Terms at any time.

13.2. Significant changes will be communicated via:

• Telegram bot notification
• Email (if provided)
• Website announcement

13.3. Continued use after changes constitutes acceptance of modified Terms.

13.4. If you disagree with changes, you must stop using services and may request account deletion.

14.1. Entire Agreement: These Terms, along with our Privacy Policy and Public Offer, constitute the entire agreement.

14.2. Severability: If any provision is found invalid, remaining provisions remain in effect.

14.3. No Waiver: Failure to enforce any provision does not waive our right to enforce it later.

14.4. Assignment: You may not assign these Terms without our consent. We may assign without restriction.

14.5. Force Majeure: We are not liable for delays or failures due to events beyond our control.

14.6. Third-Party Services: We are not responsible for third-party AI provider terms, availability, or performance.
